Michelle Foster from Melbourne Law School recently appeared on ABC’s Q & A where the legality of Labor’s Papua New Guinea Asylum Seeker resettlement plan was discussed. The other panelists were Bill Shorten, Arthur Sinodinos, Louise Adler and Tim Fischer. Among other things, at 15:17, Michelle outlined how the Papua New Guinea Asylum Seeker resettlement plan was in violation of International Law, and at 17:11, she outlined the potential for a High Court challenge to the Papua New Guinea Asylum Seeker resettlement plan and how the legislation had been changed since the High Court had ruled the Malaysian Solution was illegal in Plaintiff M70/2011 v Minister for Immigration and Citizenship [2011] HCA 32. It is highly likely that there will be a High Court challenge if the Papua New Guinea plan becomes law, as Prime Minister Kevin Rudd and Senator Bob Carr have acknowledged.
