Cases

Each High Court decision from January 2013 onwards will have its own Case Page on this blog. The Case Page provides a short synopsis of the case and, once it has been decided, a summary of the Court’s decision. It also contains links to Opinion Posts.

Each Case Page also contains a table that organises and links to important documents related to the decision: lower court decisions (in appeal cases), transcripts of special leave and Full Court hearings, and the final judgment. The ‘High Court Resources’ link directs you to the High Court’s website which contains further documents like written submissions, chronologies and replies submitted by the parties to the Court.

Finding a Case
To find a particular case, either use the search function on the right, or browse through the Pending Cases and Decided Cases category pages.

You can search for a specific by inputting party names or by tags. Tags track areas of law, particular statutes or provisions, specific legal concepts or quotes, and significant authorities considered by the High Court.

Categories of Cases

Pending Cases lists the Case Pages for all cases that the High Court has agreed to hear, but has not yet decided. Typically, a case will be added to this section once leave is granted. These entries are listed chronologically by the date on which leave was granted.

Decided Cases lists the Case Pages for all cases that the High Court has finally determined. Once judgment is handed down, cases will be moved from pending to decided. These entries are listed chronologically by the date on which judgment was handed down.

Discontinued Cases lists the Case Pages for all cases in which leave was granted and/or the case was heard by the Full Court, but were subsequently discontinued.
